Ryobi Christmas ’12 Tools of Christmas’ Promotion 2022 Terms and Conditions (the "Agreement")

 

1. The PROMOTER

1.1 The Ryobi ’12 Tools of Christmas' Promotion 2022 ("Promotion") is promoted by Techtronic Industries UK Ltd, whose registered address is Techtronic Industries (UK) Ltd. Suite A, Second Floor Marlow International, Parkway, Marlow, SL7 1YL ("Promoter").

1.2 Participation into the Promotion is deemed acceptance of this Agreement. Participants in the Promotion will be subject to the terms of use of the Ryobi website https://uk.ryobitools.eu/footer-links-en/terms-of-use/ and the participant’s personal data will be processed in accordance with the Promoter's privacy policy available at http://uk.ryobitools.eu/footer-links/privacy-policy.

 

2. ELEGIBILITY

2.1 This Promotion is open to any UK resident only over the age of 18 years at the date of entry into the Promotion. For the avoidance of doubt, this Promotion excludes any participation from Republic of Ireland. Further delivery geographical restrictions may apply when purchasing from www.RyobiTools.co.uk

2.2 Employees, officers and directors of Techtronic Industries (UK) Ltd and its affiliated companies or their family members or anyone else connected in any way with the Promotion or helping to set up the Promotion shall not be permitted to enter the Promotion, any such entries will be deemed as void.

2.3 Participants are responsible for ensuring that they are entitled to participate and proof of eligibility may be required and prizes withheld until Promoter is fully satisfied the above criteria are met.

2.4 There is no entry fee to enter this Promotion; however, internet connection and mobile data rates may apply to the participant. The cost of accessing the Promotion website will be dependent on the participant’s individual internet service provider and shall be the responsibility of the participant only. Promoter holds no liability towards participant’s costs.

2.5 By entering this Promotion, a participant is indicating his/her acceptance and agreement to be bound by these terms and conditions.

 

3. HOW TO ENTER AND FREE GIFT

3.1 The Promotion begins on 5^th November 2022 at 00:01am and ends on 31st December 2022 at 11.59pm (GMT) ("Promotion Period").

3.2 Route to entry for the Promotion and details of how to enter are via www.RyobiTools.co.uk/christmas This Promotion is only available to consumers who purchase a qualifying product (set out at Annex 1) from the Promoter. To enter the Promotion, participants must follow the instructions as set out below;

1. (i) A participant must purchase a qualifying product (listed at Annex 1) via www.RyobiTools.co.uk
2. (ii) To purchase a qualifying product (listed at Annex 1) a participant must add the qualifying product (listed at Annex 1) to their shopping cart. A qualifying product/‘starter kit’ must at least include 1x tool, 1x battery and 1x charger for £109.99 subject to the product specification listed at Annex 1 (including VAT and excluding any additional or delivery charges).
3. (iii) For the avoidance of doubt, the free gift (as set out at Annex 2) (‘Free Gift’) will be added to a participant’s shopping cart at checkout with £0.00 value. A participant will have the option to choose from the list of Free Gifts at checkout, subject to availability of the chosen Free Gift. The participant will be reminded to add a Free Gift to their shopping cart whilst browsing on the site and a further reminder at checkout.
4. (iv) It is the participant’s responsibility to ensure a Free Gift is added to the shopping cart at the point of making a purchase. If at the point of purchase, a Participant fails to add a Free Gift to their shopping cart, the Participant will no longer be eligible to redeem such Free Gift and any claims made in retrospect will be rejected.
5. (v) A participant must fill out the following details at checkout; name, surname, email address, telephone number, valid delivery address within the UK mainland only, billing address, credit card details, agree to the Terms and Conditions of purchase.
6. (vi) A participant will be sent a confirmation email once payment has been made, confirming their order (including the Free Gift) to the email address provided at checkout.

3.3 A participant who has purchased a qualifying product (listed at Annex 1) via www.RyobiTools.co.uk will be entitled to one Free Gift per order only,.

3.4 This Promotion may not be used in conjunction with any other offer or promotion that the Promotor is running on their website, unless otherwise stated.

3.5 Any refund in respect of the qualifying product (listed at Annex 1) that are subsequently returned to the Promoter are deemed void and the participant must return the Free Gift at the participant’s own expense as per the terms & conditions of sale (https://uk.ryobitools.eu/footer-links-en/terms-and-conditions/) ) to be entitled to a full refund.

3.6 The Free Gift is non-exchangeable, non-transferable and there is no cash, credit or product alternative available. In the event the Free Gift that the participant selected is not available, the Promoter shall provide a Free Gift from the list of products set out at Annex 2. The Promoter reserves the right to provide an alternative Free Gift of the same or greater value.

3.7 The Promotion is limited until stocks last. For the avoidance of doubt a minimum of 20,000 gifts are available to be redeemed.

3.8 The participants order will be delivered to the exact address the participant provides when the order is placed. Deliveries will only be made to addresses in the GB mainland & further geographical restrictions may apply but you will be notified at checkout upon entering address details – for the avoidance of doubt delivery exclusions include BT,IM,JE,GY,HS,IV4,KA2,KW,PA,PH4,ZE,TR2 postcodes. The participant is responsible for ensuring accurate address and contact details (including phone number) are included in the order. Any purchase made in the UK by a participant that is resident outside the UK, participation will be void. The Promotion will be void and non-applicable where prohibited by law and where it is necessary to do so.

3.9 Every effort will be made to deliver the goods as soon as possible after the participant’s order has been accepted and in any event within 30 days of the participant’s order. The participant will receive an email when the order has been processed and dispatched. The Promoter will not be liable for any loss or damage suffered by you through any unavoidable delay which is beyond our reasonable control, except where due to our negligence. If there is a delay, the Promoter will inform the Participant as soon as reasonably possible.

3.10 The participant is responsible for ensuring that someone is available at the given address to accept delivery of goods. If there is no-one at the given address who is able to accept delivery of the goods, the participant will be notified of an alternative delivery date or a place to collect the goods.  Depending on the carrier, the participant may be able to organise alternative arrangements directly with the carrier. The participant shall need to ensure they have signed up with the relevant carrier for alternative arrangements (e.g. DPD ‘Predict’, UPS MyChoice).

3.11  Subject to section 3.12, the Promotor’s carrier may attempt delivery up to three times and leave a missed delivery card with the tracking number and date(s) of attempted delivery if no-one is available to take delivery. If the Promotor’s carrier is unsuccessful with all delivery attempts, the shipment will be returned to the Promotor’s warehouse and a refund will be processed for the sums you have paid for the goods to the credit or debit card that you used originally, less the delivery charges the Promotor has incurred in attempting to deliver the goods.

3.12 The participant will become the owner of the goods ordered and responsible for risk of loss of or damage to them once they have been delivered to the participant.

 

4. DATA PROTECTION

4.1 Personal data relating to the participants will be used for the purposes of this Promotion in accordance with the current GDPR legislation and the Promoter’s Privacy Policy found at https://uk.ryobitools.eu/footer-links/privacy-policy/. The Promoter reserves the right to contact all participants to verify their personal data. For the avoidance of doubt, any entry made in relation to the Promotion as set out at Clause 3 will be deemed to have given consent for the Promotor to process all personal data as defined under Art.4 (1) General Data Protection Regulation 2016/ 679.

4.2 If participants give their consent to the processing of their personal data for Promoter's marketing purposes, the Promoter reserves the right to contact them regarding various Ryobi product and service promotions or other related communications. Should participants wish not to be contacted, they should write to Promoter at [email protected]. Participants can withdraw consent to such use of personal information by writing to Promoter at the email address set out above or by using the opt-out link at the bottom of the promotional emails.

 

5. GENERAL CONDITIONS

5.1 The Promoter shall not be liable for any disruption to the Promotion whether due to force majeure or other factors beyond the Promoter's control.

5.2 The Promoter will not be held responsible or liable for any technical, hardware, software, server, website or other failures or damage of any kind, to the extent that this prevents the participant from or otherwise obstructs the participant to enter in the Promotion. Claims made by fax, telephone or post will not be accepted. Incomplete checkout carts will be deemed void.

5.3  In accordance with all relevant legislation and codes of practice, the Promoter reserves the right to cancel, suspend or modify this Promotion and these terms and conditions without notice at any given time. Any changes to the Promotion will be notified to participants as soon as reasonably practicable via the Promoter’s website (uk.ryobitools.eu).

5.4 To the extent permitted by law, participants agree to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Free Gift. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter's negligence. Your statutory rights are not affected.

5.5 If any provision of this Agreement is held invalid by any law or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

5.6 The Promotion and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
